Building Regulations (Part L Amendment) Regulations 2011…..

The Minister for the Department of Environment, Community and Local Government, Phil Hogan T.D. recently signed the Building Regulations (Part L Amendment) Regulations 2011

The new regulations aim to achieve a 60% aggregate improvement (over the 2005 regulatory requirements) in the energy performance and carbon dioxide emissions for new dwellings on and from 1st December 2011 (subject to the prescribed transitional arrangements).

The operative date is subject to the transitional arrangements that follow:-

(a) A planning application is made on or before 30th November 2011 for planning permission or approval pursuant to the Planning & Development Act 2000 and where substantial work has been completed by 30th November 2013; or 

(b) A notice under Part 8 of the Planning & Development Regulations 2001 is published on or before the 30th November 2011 and where substantial work has been completed by 30th November 2013 (refers to requirements in respect of Specified Development by, on Behalf of, or in Partnership with Local Authorities). 

The Department is currently finalizing the accompanying Technical Guidance Document, Part L – conservation of Fuel and Energy – Dwellings (2011).  It is anticipated that an electronic copy of TGD – L will be available for download on the Department’s website in the coming weeks.
